1. INTRODUCTION
Welcome to Madison and Wood, LLC ( referred herein as “we,” “us,” “our”). These Terms of Use (the "Terms") govern your access to and use of our website at www.madisonandwood.com (the “Site”), including the purchase of any products offered.
By accessing our Site or placing an order you agree to be legally bound by these Terms and our Privacy Policy.
In these Terms, "Content" refers to any text, images, videos, audio files, articles, software, source code, applications, specifications, trademarks, logos, and all other information or content accessible through the Site.
2. ACCEPTANCE OF TERMS
We may, at our sole discretion, modify these Terms at any time. When we do, we will post the updated Terms on our site or send a notice via email to registered users. If you find any modification unacceptable, you must stop using the Site. Your continued use of or access to the Site constitutes your agreement to the revised Terms. These Terms do not change the terms of any other agreement you may have with us or our affiliates for other products or services.
By sending emails to us, you are communicating with us electronically and consent to receive communications from us in return. You agree that all electronic agreements and notices satisfy any legal requirement that such communications be in writing.
In the event of a material pricing error, we reserve the right to cancel any orders placed at the incorrect price, even if confirmed and charged. A full refund will be issued in such cases.
3. PAYMENT, BILLING, AND SUBSCRIPTIONS
Payment Authorization
By providing a payment method, you represent that you are authorized to use it and authorize us to charge the total amount of your order or service, including taxes and shipping fees.
Your receipt of a confirmation does not signify our acceptance of your order. It is a confirmation that we received your offer to purchase.
We reserve the right at any time to accept, decline, or limit your order for any reason, including product/provider unavailability, errors in pricing or descriptions, or suspicion of fraudulent activity.
Taxes
Prices displayed do not include applicable sales tax unless noted. Taxes are calculated based on your destination or location and prevailing local rates.
Subscriptions and Automatic Renewal
If you purchase a subscription-based product or service, it will automatically renew at the end of each billing cycle at the then-current rate. We will disclose the recurring charge amount, frequency, and cancellation deadline before you provide billing info. You may cancel at any time through your Account Settings, and you will retain access until the end of the current pre-paid period.
4. DELIVERY OF GOODS AND SERVICES
Shipping (For Products)
Shipping dates are estimates. Title and risk of loss pass to you upon our delivery of goods to the common carrier. We are not liable for delays caused by third parties or "Force Majeure" events.
International Orders
For international shipments, you are the "Importer of Record" and are responsible for all duties, taxes, and customs fees. EU/UK residents have a 14-day statutory right to cancel most orders.
Force Majeure Events
We are not liable for failures or delays caused by acts beyond our reasonable control, such as natural disasters, labor strikes, war, government actions, or widespread internet/power grid failures. If such an event lasts more than 30 days, either party may cancel the affected order or service for a refund of undelivered portions.
5. RETURNS, REFUNDS, AND CANCELLATIONS
Product Returns
Returns are accepted within seven (15) days of delivery if the item is in its original, unused condition. Final sale, perishable, or custom-made goods are non-returnable.
If you do not love your purchase, we will gladly issue store credit for the value of any approved merchandise within 15 days from possession of your order. For in-store pickup orders, we will issue store credit for the value of any approved merchandise within 15 days from notification that your order is in store and ready for pickup. After this 15 day period, the item(s) become final sale.
Items must be in NEW condition with original tags attached and cannot be worn, washed or altered. All sale items, gift cards, earrings, hats, hair accessories, bodysuits, hosiery, sunglasses and adhesive bras are FINAL SALE. MADISON & WOOD has the right to refuse an item being returned if deemed conditions have not been met. If any returns do not meet these requirements, you will be contacted via email and a shipping fee will be charged to your account in order to return your items to you.
If you have received an item with any problems or defects, please contact our Customer Care department at service@madisonandwood.com within 7 DAYS to inform us of the issue. If we are not notified within 7 days of receiving the item, it will no longer qualify for a return or replacement. You must include a photo of the damage/defect in your email. We are not responsible for damages to clothing caused by improper care/handling or incorrect sizing.
Items must be in NEW condition with original tags attached and cannot be worn, washed or altered.

MADISON & WOOD has the right to refuse an item being returned if deemed conditions have not been met. If any returns do not meet these requirements, you will be contacted via email and the items will be returned to you at your expense.
If you have received an item with any problems or defects, please contact our Customer Care department at service@madisonandwood.com within 7 DAYS to inform us of the issue. You must include a photo of the damage/defect in your email. We are not responsible for damages to clothing caused by improper care/handling or incorrect sizing.
Return Methods
By Mail
If you purchased the "Free Unlimited Return for Store Credit or Exchange" option at the original time of checkout for this order, there is no cost to ship your return back to us within the 15 day return window. You will be able to submit a return for store credit or exchange and receive a prepaid shipping label through our returns & exchanges portal.
If you did not purchase this option with your order, you can use the same portal, but a $7 shipping fee will be deducted from your store credit to cover the cost of your shipping label. Purchasing re:do with a FINAL SALE item does not make the item eligible for a return.
When we receive your return, you will receive an email to the email address associated with the original order including the gift card and details of the transaction. Please allow up to 14 business days for MADISON & WOOD to receive and process your return. All shipping costs are non-refundable.
If you would like to avoid MADISON & WOOD’s return shipping charge or are located outside of the U.S., you may send your package back on your own via an insured/trackable method to: MADISON & WOOD Returns, 2308 2nd Ave E, Suite 200, Oneonta, AL 35121. Please be sure to include the order number and email address for the store credit to be issued to you within the package.
Exchanges
For exchanges of the same or different item, please visit our returns and exchanges portal. This portal will allow you to select a new size or color of your original item or a different item and pay the difference (if there is any). We will ship out the newly selected item once the return package shows movement using the prepaid return label. You will receive a new email with the tracking number for your exchange when it is shipped.
Lost or Stolen Packages
MADISON & WOOD is not responsible for lost, stolen, delayed, or damaged packages once they have been accepted and marked as delivered by the shipping carrier. If your package is lost or stolen, please contact the shipping carrier directly to file a claim.
Refused or Undeliverable Packages
Orders returned to MADISON & WOOD due to an incorrect shipping address provided by the customer, refusal of delivery, or failure to claim the package may be subject to return shipping charges. Original shipping fees are non-refundable.
Order Cancellations
Due to our commitment to processing orders as quickly as possible, we cannot guarantee cancellation requests once an order has been submitted. All orders are considered final upon placement and cannot be canceled, modified, or changed; therefore, please carefully review your order before completing your purchase.
6. INTELLECTUAL PROPERTY & PROHIBITED USES
Ownership
Madison and Wood, LLC or its providers own all Content on this Site and is protected by intellectual property laws. We grant you a limited, revocable license for personal, non-commercial use only.
Prohibited Uses
The Site is provided for your convenience and non-commercial use only. Your access to and use of the Site must follow all applicable laws, regulations, and these Terms. You acknowledge and agree that Madison and Wood, LLC reserves the right, in its sole discretion, to temporarily or permanently suspend, discontinue, or refuse your current and future access to or use of the Site at any time, without notice or further obligation to you.
To access or use the Site, you must be of legal age (e.g., 18 years or older) in your jurisdiction, capable of forming a legally binding contract, and not otherwise prohibited from using the Site under applicable law.
AI and Scraping Restrictions
You are expressly prohibited from:
- Using any automated device (robots, spiders, scrapers) to monitor or copy Site Content.
- Extracting data for commercial purposes or competing services.
- Using Content to train, develop, or improve machine learning or artificial intelligence models without express written consent.
7. LIMITATION OF LIABILITY & WARRANTIES
Warranties
AS A CONDITION OF USING THE SITE, YOU WARRANT TO US THAT YOU WILL NOT USE THE SITE FOR ANY PURPOSE THAT IS UNLAWFUL OR PROHIBITED BY THESE TERMS.
Disclaimers
THE CONTENT PROVIDED ON THIS SITE ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL ADVICE. YOUR USE OF ANY INFORMATION OR MATERIALS ON THIS SITE IS ENTIRELY AT YOUR OWN RISK.
THE SITE AND ALL PRODUCTS/SERVICES ARE PROVIDED ON AN "AS IS" BASIS. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MADISON AND WOOD, LLC SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
Indemnification
YOU AGREE TO INDEMNIFY AND HOLD MADISON AND WOOD, LLC HARMLESS FROM ANY CLAIMS, DAMAGES, OR EXPENSES (INCLUDING ATTORNEY FEES) ARISING OUT OF YOUR USE OF THE SITE, YOUR VIOLATION OF THESE TERMS, OR YOUR INFRINGEMENT OF ANY THIRD-PARTY RIGHTS.
8. DISPUTE RESOLUTION
Governing Law
These Terms and your relationship with Madison and Wood, LLC are governed by the laws of the State of Alabama and applicable federal laws of the United States, without regard to principles of conflict of laws.
Mandatory Arbitration
Any dispute arising out of these Terms shall be settled by binding arbitration in Oneonta, Alabama. For any matters not subject to arbitration, or to enforce an arbitration award, you consent to the exclusive jurisdiction of the courts located in Oneonta, Alabama.
Class Action Waiver
YOU AGREE THAT PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION.
9. OTHER POLICIES
Product Availability
While we strive to maintain accurate inventory levels, product availability is not guaranteed. In the event an item becomes unavailable after an order has been placed, MADISON & WOOD reserves the right to cancel the order and issue a refund to the original payment method.
Product Colors & Descriptions
We make every effort to display our products as accurately as possible. However, actual colors may vary due to individual monitor settings, mobile device displays, and lighting conditions.
Return Condition Requirements
Returned merchandise must be free from makeup, deodorant marks, perfume odors, smoke odors, pet hair, stains, or any other signs of wear or use. Items returned in unacceptable condition will not be eligible for store credit or exchange and may be returned to the customer at the customer's expense.
Final Sale Items
All sale, clearance, promotional, discounted, markdown, seasonal, and final sale merchandise is final sale and is not eligible for return, exchange, or store credit.
Fraud Prevention & Abuse of Policy
MADISON & WOOD reserves the right to refuse service, cancel orders, limit quantities, deny returns, or suspend accounts where we suspect fraudulent activity, excessive returns, abuse of our policies, resale activity, or other conduct that violates these terms.
Store Pickup Orders
Customers selecting in-store pickup will be notified when their order is ready for pickup. Orders not picked up within 30 days of notification may be canceled at MADISON & WOOD's discretion and refunded in the form of store credit.
Policy Updates
MADISON & WOOD reserves the right to update, modify, or discontinue products, promotions, pricing, and policies at any time without prior notice.
10. MISCELLANEOUS
Servability
If a provision of these Terms is found to be invalid, illegal, or unenforceable in a specific jurisdiction, it will not impact the validity of any other provisions in other jurisdictions. In such cases, these Terms will be interpreted and enforced in that jurisdiction as if the invalid, illegal, or unenforceable provision did not exist. Headings and titles are for convenience only.
Account Security
You are responsible for keeping your account credentials confidential. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses caused by unauthorized access to your account.
Termination of Use
We reserve the right to terminate your access to our Services at any time, with or without cause. If we terminate a pre-paid service for our convenience, we will provide a pro-rata refund for the remaining undelivered portion.
Survival
Any sections of these Terms which by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Limitation of Liability, Indemnity, and Dispute Resolution.
